“There has never been a case like this; it’s the best we could do”

Málaga CF’s judicial administrator, José María Muñoz, spoke at a press conference at La Rosaleda after the agreement with SC Braga to resolve the ‘Horta Case’ was made official.

Muñoz, accompanied by the Club’s general manager, Kike Pérez, began his press conference by explaining its purpose. “I felt it was a responsible gesture to explain the agreement with Sporting Clube de Braga. Our goal was to reach a good agreement,” he clarified.

The aim was to amicably resolve the dispute stemming from the CAS procedures over the legal conflict involving former Málaga player Ricardo Horta, now a footballer for the Portuguese club SC Braga. This was achieved through an initial payment, a payment schedule, adherence to the agreement, confidentiality, and the applicable regulations between the two clubs.

José María Muñoz explained that the agreement amounts to a net sum of 7 million euros, of which Málaga CF will receive 50% and retain a 50% share of any future sale of Horta.

Resolution of the agreement

“There are two independent entities. Over there, they are two completely different bodies, and there has never been a case like this. The three arbitrators told us this was the best we could have done. We issued a brief statement to provide the necessary explanations here. If there is a future sale of the player, Málaga will receive 50%.”

Horta, a ‘non-transfer’
“We are talking about a ‘non-transfer.’ The origin of this registration leans more towards the concept of a transfer than an extraordinary income. However, I leave it to LaLiga to assess, as they are the ones who will validate it.
Caution.”

Process closed
“Extending the process further? Not at all. When one appeals, the resolution is suspended. Swiss legislation mandates that when an appeal is filed, it is automatically suspended.”


Muñoz also addressed the organisational structure of the Club, which includes NAS Football SL, NAS Spain SL (Management Empresarial Málaga SL – Nasir Bin Abdullah and Sons SL), and the Small Shareholders of the Martiricos entity. He referred to the court order dated 18th August 2023, which emphasises that “the precautionary measure will continue to be exercised with the same functions” and “will cease under the circumstances and conditions provided in the Law on Corporations and in this resolution.”

Rights
“What I am doing is fulfilling the mandate. I continue to hold Málaga’s rights. If the precautionary measure no made sense, there would be a cessation of the judicial administrations, and the club could return to Al Thani. I will try to ensure the greatest normalcy and coherence possible with the person who succeeds me.”

Continuity
“I came for an indefinite period, renewed every six months. As for a potential departure? I am not ready to make a statement or predict a timeline. But there are certainly many ways to bring this to an end.”
