Volunteering Contract

VOLUNTEER COLLABORATION AGREEMENT - It is stated:

I. That the Fundación Deportiva Málaga Club de Fútbol, S.A.D. (hereinafter the Foundation) is of Spanish nationality, is legally constituted, and is duly registered in the Registry of Foundations. The Foundation has its own legal personality and includes, among its general interest purposes as outlined in its statutes, participation in sports activities.

II. That, as stated above, the set of activities of the Foundation must be classified as of general interest, in accordance with the requirements of Article 6 of the aforementioned Law 45/2015, and that this legal norm is applicable to this particular agreement, as this entity also meets all the requirements established in its Article 13.

III. That the Volunteer is interested in carrying out and participating in activities of general interest included within the scope of the Foundation's organization, altruistically and in solidarity, without receiving any financial compensation, and more specifically in the COLABORACIÓN MÁLAGA CF project for the development of the 2025/2026 season.

IV. That both parties expressly wish to state that the relationship arising from the collaboration agreement does not have a labor nature nor constitutes a civil or commercial service provision, being altruistic in nature and subject exclusively to the regime provided in the aforementioned Law 45/2015 on volunteering.

In consideration of the above, the parties have agreed to enter into a collaboration agreement, subject to the following.

 

STIPULATIONS

First. - The Volunteer will join the Foundation as a volunteer, altruistically and without receiving any financial compensation, to carry out the functions and activities of general interest specified in this agreement.

Second. - The Volunteer will participate in the COLABORACIÓN MÁLAGA CF project during the 2025/2026 season in all events organized by MÁLAGA CF or its foundation, at the La Rosaleda Stadium, Ciudad Deportiva, and/or other facilities, providing all their technical knowledge, as well as their experience, initiative, and capacity.

Third. - In the development and execution of the volunteer activities regulated in this document, the Volunteer commits to fulfilling the duties established in Article 11 of Law 45/2015, and specifically the following:

a) Fulfill the commitments made with the volunteer entities they join, as reflected in the incorporation agreement, respecting their purposes and statutes.

b) Maintain the confidentiality of the information received and known during their voluntary action.

c) Reject any material or financial compensation they may receive, either from the beneficiaries of the voluntary action or from other persons related to their voluntary action.

d) Respect the rights of the beneficiaries of the voluntary action as provided in Article 16.

e) Act with due diligence and in solidarity.

f) Participate in the training tasks provided by the volunteer entity for the entrusted activities and functions, as well as those required on an ongoing basis to maintain the quality of the services they provide.

g) Follow the instructions of the volunteer entity related to the development of the assigned activities.

h) Properly use the personal accreditation and badges of the volunteer entity.

i) Respect and take care of the material resources made available by the volunteer entity.

j) Comply with the safety and health measures in place at the volunteer entity.

k) Observe the rules on the protection and processing of personal data in accordance with the provisions of Organic Law 3/2018. In this regard, the Volunteer expressly consents and authorizes the use of their image by the FUNDACIÓN DEPORTIVA MÁLAGA CLUB DE FÚTBOL, S.A.D. and/or MÁLAGA CLUB DE FÚTBOL, S.A.D. for use on their social networks to promote the COLABORACIÓN MÁLAGA CF project for the 2025/2026 season.

 

Fourth. - The Volunteer commits to performing the activities and functions specified in the previous clauses without prejudice to the conditions determined by the Foundation's Management, depending on the circumstances, needs, and objectives of the project. This commitment will last for the specified duration, ceasing to have effect and resulting in the immediate disengagement of the parties without the need for prior notice or any other formality, thereby terminating the relationship between the Volunteer and the Foundation in all respects.

 

Fifth. - The Volunteer, for the performance of the agreed functions and tasks under this agreement and during its validity, will have the right to have the Foundation reimburse any expenses they are required to incur, provided they have been previously authorized. To this end, the Volunteer must submit the corresponding expense report and, if applicable, proof of such expenses.

During the validity of the agreement, the Volunteer will be included in the Insurance Policy against illness and accident risks formalized by the Foundation, in accordance with the provisions of Article 14 of Law 45/2015.

 

Sixth. - The following will be grounds for termination of this agreement or disengagement of the Volunteer from the Foundation:

1.- Mutual agreement.

2.- Termination by personal decision of the Volunteer.

3.- Termination by decision of the Foundation, notified to the Volunteer.

4.- Fulfillment or completion of the project subject to this agreement.

5.- Breach of the obligations outlined in this agreement.

 

Eighth. - The unilateral termination of the volunteer relationship will not result in any economic consequence for either party, nor any compensation or indemnity of any kind or amount. Any extraordinary expenses that may arise, such as travel, accommodation, compensations to third parties, etc., will be borne by the party deciding on such termination, without prejudice to the legal liability that the non-compliant party may incur towards the other party or third parties.

 

Ninth. - Matters not provided for in this agreement will be governed by the specific legislation in force, and more specifically by Law 45/2015, of October 14, on Volunteering. The Volunteer accepts.
